This website is operated by Tracey Gofton (referred to as ‘we’/’us’/‘our’/Seller’). As a user of this Website (referred to as ‘you’/’your’/Buyer’) you agree to be bound by these Terms and Conditions, whether or not you make a purchase. Where you do not agree to our Terms and Conditions please cease using this site immediately and place no orders.
Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.
These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions.
Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

For bespoke Millinery orders please allow 4- 6 weeks from when you place your order to receiving your item(s). All bespoke millinery items are made to order. The above time scale is a guideline, we will always endeavour to produce and despatch your items are quickly as possible.
When you have placed your order you will automatically receive an email from Tracey Gofton and a proof of purchase receipt confirming the details of your order.
Once we have checked our ability to supply you with your goods and when your payment has also cleared we will send you an additional email confirming your order. This acceptance by us of your order completes the sale and purchase contract between you and us. We will send you a further email when your order has been despatched.
By placing an order from our website you are warranting that you are over 18 years of age and have the capacity to enter into this contract
We are entitled to refuse your order placed by you at anytime without explanation and any monies paid will be refunded through PayPal.
If you require your head piece before the standard 4-6 weeks please contact us before placing your order email@example.com and we can discuss your requirements, we will then confirm if your rush order can be accommodated. All rush orders will incur an additional £25 surcharge. Once confirmed, we will send you a separate invoice.
PRICING AND PAYMENT
The price does not include VAT, we are not VAT registered. All prices are quoted in pounds sterling. Payment will be required upfront
Our method of payment is through the our website , BACS transfer or cheque. Product prices are subject to change, without notice.
The total purchase price and delivery charges which may vary depending on location, if you are unsure of delivery costs please contact us directly prior to order.
A selection of our designs seen on this website can usually be created in different colours, sizes and materials – please send us an email before you place your order to discuss this further at firstname.lastname@example.org
The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflect the colour of the products. Your item may vary slightly from those images due to your computer’s monitor. You therefore except that there may be differences in the actual appearance of the products.
UK Postage and Packaging prices , if applicable, range from £5.50 to £10:00.
Millinery and Commissioned Millinery orders will be despatched within 4-6 weeks
For the EU and The Rest of The World please contact us directly for prices at email@example.com before placing your order. Please be aware that we are not responsible for any customs tax or import duties.
You will receive an email once your item(s) have been despatched.
Goods will be sent to the address given by you in your order. You are responsible for ensuring that the delivery details you provide are accurate and correct.
We are unable to guarantee an exact delivery date. A signature will be required upon receipt.
We take great care and pay attention to detail in the quality of our products and our policy is to ensure that all products supplied reach you in top condition.
As the majority of our designs are handmade to order, we are always happy to advise customers regarding style suitability, colour matching and measuring prior to placing an order.
If for any reason the product does not meet your expectations, you can return or exchange goods bought from us where possible, provided a return is requested within 7 days of receipt and items are returned to us within 14 days and meet the requirements outlined below.
Returns are accepted on ready to wear pieces. We regret that we are unable to offer refunds or exchanges on products that are bespoke, made to order or customised. However, customer satisfaction is of upmost importance and if you are not completely happy with your new design, please contact us within 7 days of receipt and we shall attempt to resolve your concerns. We want you to be delighted with your new hat or headpiece!
To return or exchange your purchase please email firstname.lastname@example.org stating your request for a refund or an exchange, please provide all relevant details for the return, you will be notified how to proceed as soon as possible. You must send this email within 7 days of receiving your product.
All returns must be in an unworn, unmarked, as new condition and complete with their original tags in place as received.

We are entitled to make a deduction from the refund for any diminution in value of the returned goods caused by handling the item beyond what’s necessary to be sure they are what you ordered.
A refund will be issued to the original card that was used for the purchase within 7 days of receipt of the return once the return has been inspected to ensure all criteria are met.

You will be responsible for the cost of returning items; we recommend that you ensure the parcel against loss or damage.
If you wish to report a faulty item, please contact us. Please ensure you keep all packaging to process your claim. It is also important that when you sign for your item that you ask the postal worker to mark the item as received damaged.
This policy does not affect your statutory rights.
RIGHTS OF SELLER
The Seller reserves the right to periodically update prices on the Website, which cannot be guaranteed for any period of time. The Seller shall make every effort to ensure prices are correct at the point at which the Buyer places an order.
The Seller reserves the right to withdraw any Goods from the Website at any time.
The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.
AGE OF CONSENT
By placing an order from our website you are warranting that you are over 18 years of age and have the capacity to enter into this contract.
If the Seller discovers that the Buyer is not legally entitled to place orders, the Seller shall be entitled to cancel the order immediately, without notice.
LIMITATION OF LIABILITY
Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.
Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller’s agents or employees.

The contents of our website (including pictures, millinery designs, product designs, website designs, logos, photographs, text written and other materials) are the copyright trademark and/or registered trademark of Rubyrose.design
The copying, modification, distribution, reproduction, or incorporation into any other work of part or all of the material available on this website in any form is prohibited without permission.
No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.
The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to, acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.
CHANGES TO TERMS AND CONDITIONS
The Seller shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.
GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the law of England and Wales and the parties hereby submit
to the exclusive jurisdiction of the English and Welsh courts.
